Как соотносятся между собой внутригосударственное и международное право?
В науке международного права по этому вопросу выделяют два основных направления: монистическое и дуалистическое.
Монистическое направление, в свою очередь, распадается на две теории: примата международного права и примата внутригосударственного права. Исторически первой была теория примата национального (внутригосударственного) права. Ее суть сводится к отстаиванию превосходства национального права, т.е. главным и ведущим правом является внутригосударственное, а международное право играет второстепенную роль.
Теоретическая концепция примата международного права сводится к тому, что международное право имеет приоритет над внутригосударственным. Действительно, исходя из прямолинейного толкования п. 4 ст. 15 Конституции РФ, иногда может показаться, что это так. На самом деле все обстоит значительно сложнее. Прямого примата международного права над внутригосударственным нет.
Представители дуалистической теории выдвигают доводы в пользу того, что обе правовые системы — международная и внутригосударственная — развиваются сами по себе. У них разные объекты регулирования, разные субъекты права, неодинаковые источники. Современный дуализм выступает за диалектическое взаимодействие между двумя системами права.
Какое влияние оказывают друг на друга внутригосударственное право и международное право?
Исторически первично было влияние внутригосударственного права на международное. Затем происходит обратное влияние — международное право оказывает сильное воздействие на внутригосударственное. В настоящее время можно говорить об обоюдном взаимодействии указанных правовых систем друг на друга.
В свою очередь, международное право оказывает существенное влияние на внутригосударственное право. Примером может служить Конституция РФ 1993 г. (п. 4 ст. 15), в которой речь идет об автоматическом включении общепризнанных норм и принципов международного права, положений международных договоров РФ в правовую систему России.
Можно говорить о влиянии международного права на внутригосударственное в аспекте формулирования прав и свобод человека и гражданина, организации и деятельности органов внешних сношений, подготовки и принятия международных аспектов внутригосударственных законов и иных нормативных правовых актов.
Большое влияние на внутригосударственное право оказывают решения международных органов, в том числе Совета Безопасности ООН, Международного суда ООН, ряда международных организаций, в том числе в области обеспечения международной безопасности, а также прав и свобод человека.
Каким образом системы международного и внутригосударственного права согласуются друг с другом?
Международное право не предписывает, каким образом нормы международного права трансформируются в национальное. В науке международного права применяются термины трансформация, имплементация, рецепция. Однако как бы ни называли процесс внедрения норм международного права в национальное, суть его остается неизменной: нормы международного права становятся составной частью национальной правовой системы, т.е. национальное право подчиняется нормам международного права.
В любом случае трансформация носит условный характер, поскольку нормы международного права не теряют присущей им правовой природы. Как отмечают специалисты, никакого превращения одних норм в другие не происходит и произойти не может. Сущность трансформации состоит в обеспечении государством выполнения международных обязательств посредством своих властных полномочий, естественным следствием чего является укрепление единства различных правовых систем.
