Международный договор и международный обычай являются двумя основными способами создания норм международного права.
Договорная норма. Общепризнано, что основным способом создания норм международного права является международный договор.
Международный договор устанавливает известные обязательные отношения между государствами, которые его заключили и всегда служил одним из лучших средств для выяснения и определения правовых отношений, даже принципов права, которые должны господствовать в области международных отношений.
Договоры заключаются только субъектами международного права и прежде всего суверенными государствами, межправительственными организациями, нациями и народами, борющимися за свое освобождение, государственно-подобными образованиями.
Процесс заключения международного договора проходит ряд этапов: переговоры, согласование текста, парафирование его, принятие на международной (дипломатической) конференции, подписание, ратификация (присоединение), вступление в силу, регистрация в Секретариате ООН, опубликование в книге «Тгеаtу Series»."
Международно-правовой обычай. В отличие от договорных норм международно-правовой обычай не является результатом согласования воль субъектов международного права.
Opinio juris (правовой принцип) означает, что государство рассматривает то или иное обычное правило как норму международного права, как правило, юридически обязательное в международном плане. Это выражение воли государства. Когда другие государства также выражают волю в том же направлении, образуется молчаливое соглашение о признании обычного правила в качестве международно-правовой нормы.
Согласно подп. «Б» п. 1 ст. 38 Статута Международного суда ООН для признания международно-правового обычая необходимы два условия: всеобщая практика и признание обычая в качестве правовой нормы.
Как правило, обычная норма международного права формируется постепенно. Она возникает в результате повторяющихся действий всех субъектов международного права, а не только государств.
Иные способы создания норм международного права. Нормотворчество в международном праве не ограничивается договором и обычаем. Нормы международного права могут быть созданы и иными способами, например решениями межправительственных организаций. Последние могут также ускорить процесс создания, совершенствования или отмены международно-правовой нормы.
Понятие кодификации и прогрессивного развития международного права. Кодификация международного права - это усовершенствование и прогрессивное развитие действующих принципов и норм международного права путем приведения их в определенный порядок. В результате кодификации уточняются и изменяются действующие нормы международного права, а также разрабатываются новые нормы.
Кодификация международного права может быть официальной, осуществляемой на международном уровне или в рамках межправительственных организаций, и неофициальной, проводимой международными неправительственными организациями, научными учреждениями и учеными.
