Tasks for self preparation:

Questions for preparation to the seminar:

  1. The notion of labour discipline and methods of its supporting.

  2. Labour routine. Basic rights and duties of employer and employee.

  3. The notion, grounds and types of incentive for success in work (stimulation). The procedure of its applying.

  4. The concept of disciplinary offence and its essential elements. The grounds and conditions of disciplinary responsibility.

  5. Disciplinary penalties.

Tasks for independent work:

Basic level:

1. Compose the glossary of main legal terms to the topic relying on the list of terms below.

Main terms: internal labour policy, internal labour regulations, incentive (stimulation) for success in work, labour discipline, technologic labour discipline, disciplinary liability, disciplinary offence, subject of disciplinary offence, subjective side of disciplinary offence, general disciplinary responsibility, special disciplinary responsibility, disciplinary penalty, reproof, disciplinary dismissal.

2. Familiarize oneself with prescribed list of literature and summarize the information, write down the abstract from this topic to your notebook.

Questions for self preparation:

  1. Legal regulation of labour routine.

  2. The notion, grounds and types of incentives for success in work (stimulation) and the procedure of its applying.

  3. Disciplinary penalties, the order of their application, appeal and removal.

High level:

1. To prepare report on one of prescribed topics and prepare to its defending.

Topics for reports:

  1. Internal labour routine.

  2. Special disciplinary penalties.

Tests for self-check:

  1. Disciplinary penalty can be applied to an employee during such term:

    1. not later than 3 months from the day of exposition, not later than 4 months from the day of commission of disciplinary offence;

    2. not later than 1 month from the day of exposition, not later than 6 months from the day of commission of disciplinary offence;

    3. not later than 1 month from the day of exposition, not later than 3 months from the day of commission of disciplinary offence;

    4. not later than 2 months from the day of exposition, not later than 6 months from the day of commission of disciplinary offence;

    5. not later than 1 month from the day of exposition, not later than 4 months from the day of commission of disciplinary offence.

  2. Such of listed items point on disciplinary penalties:

    1. reproof;

    2. deductions from wages or salary;

    3. compensation of the inflicted harm;

    4. dismissal in relation with transfer to another job;

    5. fine.

  3. Information about penalty, applied to an employee (except disciplinary dismissal) should be recordered to the labour book of the employee:

    1. in the day of enacting of order of employer;

    2. after signing of the employer’s order about imposition of penalty;

    3. never;

    4. after a concordance with a trade-union committee.
