SOUTH AFRICA

PROBABILITY OF DISCHARGE:

(1) The probability of adischarge resulting from damage to the vessel or its equipment is a reason for making a report. In judging whether there is such a probability and whether the report should be made, the following factors, among others, should be taken into account:

(a)The nature of the damage, failure or breakdown of the vessel, machinery or equipment; and

(b)Sea and wind state and also traffic density in the area at the time and place of the incident.

(2)It is recognised that it would be impracticable to lay down precise definitions of all types of incidents involving probable discharge which would warrant an obligation to report. Nevertheless, as a general guideline, the Master of the vessel should make reports in cases of:

(a)Damage, failure or breakdown which affects the safety of the vessel; examples of such incidents are collision, grounding, fire, explosion, structural failure, flooding, cargo shifting etc.

(b)Failure or breakdown of machinery or equipment which results in impairment of the safety of navigation; examples of such incidents are failure or breakdown of steering gear, propulsion plant, electrical generating system and essential shipbome navigational aids.

DESCRIPTION:

South Africa has established a requirement for pre-arrival and pre-en1ry information under the Merchant Shipping (Maritime Security) Regulations 2004.

VESSELS REQUIRED TO SUBMIT PRE-ARRIVAUPRE-ENTRY INFORMATION:

(1)Pre-arrival information is required from the following vessels on international voyages bound for South African ports:

(a)Foreign passenger vessels

(b)Cargo vessels of 500 or more GT

(c)Mobile offshore drilling units (MODU's)

(2)Pre-entry information is required from the following vessels bound for a South African port:

(a)Foreign-going South African passenger vessels

(b)Cargo vessels of 500 or more GT

(c)Mobile offshore drilling units (MODU's)

(3)These requirements do not apply to the following vessels:

(a)Fishing vessels

(b)Vessels used solely for sport or recreation

(c)Government vessels engaged solely on non-commercial voyages

(d)Coasting vessels

(e)Vessels transiting South Africa'sterritorial waters (such vessels are however encouraged to participate to avoid possible delays)

REPORTING RULES:

(1)The Maritime Rescue Co-ordination Centre (MRCC) in Cape Town is the first point of contact for pre-arrivaVpre-entry information. The pre-arrivaVpre-entry information report must be in English and in writing and is to be transmitted to the MRCC via Cape Town Radio. The MRCC will only accept reports directly from the ship via Cape Town Radio; no reports by voice communication will be accepted.

(2)A pre-arrival/pre-entry information report must be transmitted at least 96h before the vessel'sexpected time of arrival (ETA) at her first South African port. If the ship is arriving from a foreign port where the voyage time between ports is less than 96h, the Master must ensure that the pre-arrival/pre-entry information is sent in compliance with the 96h requirement and updated when the ship clears the last foreign port.
