635 pp. до н. е.), завоювавши Елам, впрягає його царів у свою колісницю на знак перемоги, і він же запрошує людей Еламу тимчасово оселитися на території Ассирії внаслідок голоду, який спустошив їхню землю. Таким чином, з позицій стародавнього міжнародного права, жорстокість війн є лише засобом (причому легітимним з точки зору більш цивілізованої нації, яка завойовує менш розвинуту, і поширює на неї своє віросповідання); цивільне ж населення поза війною є недоторканним і потребує гуманного ставлення, в тому числі незалежно від віросповідання.

Поширеною практикою було укладання військових союзів. Так, якщо союз був рівноправним, його мета полягала в наданні взаємної військової допомоги; у випадку нерівноправного союзу таку допомогу залежним державам надавала країна — глава союзу.

Такі союзи оформлювались міжнародним договором та клятвами сторін (союз між Афінами й Коринфом 375 р. до н. е.). Військові союзи Стародавнього Китаю серед інших функцій приділяли увагу обмеженню озброєнь і регулюванню ведення війн. Під їхньою егідою укладались і договори про мирні відносини по закінченні війни.

Найбільшої специфікації військові союзи набули в античній Греції, де вони поділялись на оборонні (епімахії) та наступальні (симахії). Серед перших — договір між Афінами та Лакедемоном; других — Коринфська ліга проти Спарти 395 р. до н. е.

Інститут нейтралітету був відомий Індії та Китаю і менше — Близькому Сходу. Хетським правом війни передбачалось, якщо з іншою державою було укладено договір про дружбу, то її нейтралітет під час війни хетів з третьою стороною розглядався як недружній акт.

У Стародавній Греції поняття нейтралітету оформилося в правовий інститут і отримало концептуальне пояснення. Державі досить було в односторонньому порядку проголосити себе нейтральною у війні чи інакше дати знати про свій намір, щоб її статус стали поважати воюючі сторони. В іншому випадку укладалися спеціальні договори про дружбу (філії), які являли собою правову підставу нейтралітету.

Староіндійські держави сповідували нейтралітет трьох видів: 1) стхана (мовчазне дотримування); 2) асана (відмова від ворожих дій); 3) упекшана (необережний, нестійкий нейтралітет). «Махаб-

харата» розрізняла чотири види нейтралітету: 1) нейтралітет того, чия позиція вагома для розвитку конфлікту; 2) нейтралітет того, хто практично не може вплинути на хід конфлікту; 3) нейтралітет того, хто може вплинути на хід конфлікту на прохання воюючих сторін; 4) нейтралітет того, хто політично слабкий і не може впливати на конфлікт, хоча його матеріальні ресурси можуть вплинути на його перебіг. Надання з боку нейтральної сторони будь-яких переваг воюючій стороні автоматично призводило до втрати нейтралітету.

Існувала складна релігійна процедура, яка супроводжувала війну. Перед початком походу стародавні хети, ассирійці, з'ясовували волю богів; нерідко правитель стародавньої держави звертався до богів з метою благословення війни. Ведення війни перебувало під контролем богів, а сама війна часто розглядалась як протиборство між богами сторін.

Виникають інститути арбітражу і посередництва як засоби запобігання війні, які особливо були розвинуті в античній Греції.
