6. Penalty clause in case of non-reporting /non-forwarding of labour contract

In case the intermediary activities of ECR lead to the engagement into the principal's service of one or more employees, proposed by ECR, within a year after the date at which these hospitality employees were proposed to the principal and the principal has omitted to report this to ECR, the principal incurs a fine at call of twice the monthly salary, as mentioned in the “Attachment to the contract ECR”.

7. Permission of use of business name

By signing this contract the principal entitles ECR to use the business-name when approaching and recruiting applicants for her database.

8. Application of law

The Dutch law is applicable to this contract.

9. Competence of judge

Disputes between parties will be submitted to a competent district court judge in Maastricht, The Netherlands for adjustment.

10. Adjustment of disputes

In deviation from what has been defined in the preceding article, parties may agree upon an adjustment of their disputes by means of a binding advice or arbitration.

11. Acceptance

In appending his signature below, the principal acknowledges that he has the authority to bind the parties and further agrees to be bound by the Terms and Conditions noted herein. In the absence of an authorized signatory, de facto acceptance of these Terms and Conditions will have been established in all cases where the principal has been sent candidate details, or the principal agreed meet a candidate suggested by ECR or the principal has offered to employ a candidate suggested by ECR.
