Legal aid
Legal aid helps with the costs of legal advice for people who cannot afford it. If you need help with the costs of legal advice, you can apply for legal aid. Whether you will receive it will depend on:
• the type of legal problem you have;
•your income (how much you earn) and how much capital (money, property and belongings) you have - called ‘financial eligibility’; and
• whether there is a reasonable chance of winning your case and whether it is worth the time and money needed to win.
For most cases, you must be ‘financially eligible’ to receive legal aid. This means that to decide whether you can receive legal aid, we will look at:
your disposable income (money you have left after paying all your living expenses); and
•your disposable capital (money, investments or property that you could use or sell to pay
for legal help).
In most cases, we will also take into account your husband, wife or partner’s disposable income and capital.
You will not be financially eligible if:
your gross income (income before tax) was more than £2,435 in the last month; or
you have more than £8,000 disposable capital.
If neither of these apply to you, we will still have to look at your finances, and the type of case you have, before deciding whether you are financially eligible. If you’re not eligible for legal aid, but you’re still worried about how to pay for legal advice or representation, there are other options:
a legal advice or law centre, which may give you free advice;
a conditional-fee (‘no-win, no-fee’) agreement;
legal-expenses insurance to pay for your legal costs; or
help from your (or your partner’s) trade union.

А. Цивільне право займається переважно спорами між фізичними та юридичними особами. Судовий процес починається потерпілою стороною. Для подання більшості позовів використовується бланк позовної заяви, який слугує викликом до суду. Цей бланк використовується для різних видів позовів, наприклад, про визначені або невизначені грошові суми, або для позовів, в яких позивач звертається до суду з проханням видати певне розпорядження. Як тільки позов було подано до суду, копія документа вручається відповідачу разом з пакетом бланків відповідей на позов, щоб відповідач визнав претензію, заповнивши бланк визнання, або заперечив позов, використавши бланк заперечення. Пакет також містить бланк повідомлення про вручення для підтвердження отримання позовної заяви, а також бланк зустрічного позову для випадку, коли відповідач вирішить подати позов проти позивача. Відповідач мусить надати відповідь протягом 14 днів з моменту вручення йому конкретних претензій. Він може отримати дозвіл на подовження терміну для подання заперечення позову, заповнивши ту частину бланка повідомлення про вручення, яка заявляє про намір заперечити позов. Якщо відповідач не надасть відповідь на позов, позивач може отримати заочне рішення суду. Суд винесе рішення на його користь без судового розгляду. Якщо відповідач хоче заперечити позов, але не має належних заперечень, суд може винести рішення щодо позову без судового розгляду в порядку спрощеного судочинства. Суд може винести рішення в порядку спрощеного судочинства проти позивача, якщо є очевидним, що його позов не має жодних обґрунтованих шансів на успіх. Успішні судові процеси у цивільних судах можуть закінчитися тим, що особі, яка подала позов, будуть відшкодовані збитки. Розмір відшкодувань різниться відповідно до обставин кожної справи.
Б. Цивільне правосудця в Англії та Уельсі здійснюється переважно судами графств та Високим судом, при цьому Високий суд займається більш суттєвими та складними справами. У Шотландії більша частина цивільних справ розглядається в судах шерифа. Усі справи, пов’язані з товарами, власністю, поверненням боргів, порушенням договору, підлягають цивільно-процесуальним нормам. Норми, які набули чинності у 1999 році в Англії та Уельсі, спричинили докорінні зміни у цивільному процесі в судах графств та Високому суді.
Суддя виконує роль керівника процесу судового розгляду. Суд встановлює розклад судового процесу, й сторони зобов’язані дотримуватись часових термінів, які регулюють розвиток справи. Процесуальні норми доповнюються детальними інструкціями, що даються суддею. Правильність позову має бути доведена на основі ступеня ймовірності. Ймовірність, що відповідач підлягає відповідальності, має перевищувати 50 відсотків.
Значна кількість цивільних спорів взагалі не потрапляють до суду, а більшість із тих, що потрапляють, не досягають стадії судового розгляду. Чимало справ вирішуються у порядку подання претензій, встановленому статутом, або через посередництво та переговори. Арбітраж також є загальноприйнятим у спорах, пов’язаних з торгівлею та будівництвом. Омбудсмени мають повноваження приймати рішення щодо скарг відносно державного сектора, а також деяких видів діяльності у приватному секторі, наприклад банківського обслуговування, страхування й пенсії. Крім того, існує велика кількість трибуналів або судів спеціальної юрисдикції. Вони займаються переважно справами, що стосуються прав громадян, порушених державою у таких сферах, як соціальне забезпечення, прибутковий податок, психічне здоров’я та зайнятість. Трибунали в Англії та Уельсі щорічно розглядають понад мільйон справ.
